MOD BIKES Limited Warranty Terms and Conditions

The MOD BIKES Warranty Information sets forth the terms and conditions of the warranty provided by MOD BIKES, an Austin-based company. ("MOD BIKES"), for its electric bikes (the “e-bikes”) and additional products (the "products"). By purchasing and using a MOD BIKES e-bike, you acknowledge and agree to be bound by all applicable terms and conditions, including Warranty details outlined herein. 


MOD BIKES introduced its limited warranty for all models starting in January 2022. Any bikes purchased prior to this date are excluded from the warranty coverage. This warranty applies only to bikes bought in or after January 2022 and covers key components such as the frame, fork/suspension, electric system, and drivetrain. Customers with pre-2022 models are not eligible for the protections outlined in the current warranty policy.

Limited Warranty Coverage

MOD BIKES offers a limited warranty that covers manufacturing defects and faults in workmanship for a specified period from the original date of purchase according to the details and terms provided herein. The MOD BIKES warranty applies only to the original purchaser of the bicycle and is not transferable to subsequent owners.  You may be required to show proof of purchase. The warranty coverage varies depending on the components and parts of the e-bike and is subject to the terms and conditions outlined herein.

MOD BIKES limited warranty coverage accepts warranty claims exclusively within the US and Canada only, due to foreign warranty policies and associated shipping and related costs. 


THE DECISION OF DETERMINING WHETHER DAMAGE OR DEFECT TO AN EBIKE OR A COMPONENT IS PROTECTED BY MOD BIKES LIMITED WARRANTY SHALL BE AT THE SOLE DISCRETION OF MOD BIKES.

While all MOD BIKES e-bikes can be assembled by the customer, it is highly recommended that all e-bikes are assembled and tuned by a professional mechanic, such as Velofix or your local E-bike shop. Improper assembly or installation can lead to significant issues and damaged components and these are not covered under MOD BIKES warranty.

Warranty Claims Process

Please ensure your claim falls under our warranty guidelines outlined below.  Claims that do not meet our guidelines may be denied or require additional follow-up.


MOD BIKES will not replace any component under warranty without being provided photo or video documentation of the damaged component(s).


To file a Warranty Claim, please submit a request through the MOD BIKES Support Form with the requested information.

Shipping Damage Coverage

The MOD BIKES warranty does not cover damage to a bicycle or accessory that occurs during shipping. However, despite this limitation, MOD BIKES agrees to replace damaged components, under the following conditions:

  • Shipping damages must be reported through the MOD BIKES Support Form within 7 days of shipment arrival
  • Photo documentation is required of both product damage and original packaging
  • This applies to all products including bikes and accessories


Shipping Costs

MOD BIKES will not cover shipping costs associated with the replacement of warranty parts, outside of the lower 48 states. The replacement part will only be shipped to the original address the order was delivered.

 

Covered Components

Frame - 5 Years

The Bike Frame

MOD BIKES will cover a 1-time replacement in the event of a broken frame or broken frame weld as long as the break or issue is not caused by improper use, abuse, or lack of proper maintenance. Warranty includes the frame itself, not any components, unless they separately meet warranty requirements, and/or the labor charges involved with moving or migrating parts. Paint, graphics, and logos are not included in this definition. Labor charges to changeover parts to the replacement frame are not included.

 

Fork and Suspension - 18 Months

Fork and shocks (rear and front)

Covers manufacturing defects and faults in workmanship according to the original manufacturer’s warranty.

 

Electric System - 18 Months

Motor, battery, display, and controller

Covers electrical components for manufacturing defects and faults in workmanship.

void the MOD BIKES batteries are designed to retain up to 75% of their original capacity during the term of the warranty period.  MOD BIKES will not cover any damages or malfunctions resulting from misuse, improper handling, accidents, drops, collisions, improper storage, neglect, or failure to follow the recommended maintenance procedures outlined in the user manual. Unauthorized upgrades to the electrical system including but not limited to hardwiring lights, horns, turn signals, and other unapproved electrical components will result in a void of warranty. Tampering with, breaking the seal, or opening your battery will void the warranty. Additionally, the warranty will be void if the electric system has been subjected to overcharging and/or exposure to extreme weather conditions.

**Bike Chargers are not covered under warranty. Chargers are a sensitive electronic component, easily affected by drops, movement, and various electric currents. 

**Battery fuses are not covered under the warranty.  


Drivetrain - 12 months

Derailleur, chain, cassette/freewheel, chainring and crank, pedals and shifter

Covers components for manufacturing defects, faults in workmanship, and failure in functionality, according to the Original manufacturer’s warranty.
Does not include normal wear and tear.


Conditions for Warranty Voidance

Effect of Unauthorized Modifications

At MOD BIKES, we are dedicated to providing e-bikes of exceptional quality, performance, and safety. To uphold these standards, it is essential to define the circumstances under which our warranty may be voided due to modifications and customizations performed by the owner.


Modifications and Customizations:


Aftermarket Electrical Components: Installation of batteries, controllers, motors, or modifications to electrical wiring that are not explicitly approved by or conforming to the specifications set forth by MOD BIKES.


Mechanical Alterations: Structural modifications to the frame, fork, handlebars, wheels, or any integral component that could compromise the e-bike’s structural integrity, safety, or operational performance.


Software Adjustments: Unauthorized modifications to the e-bike’s firmware or software settings, including changes affecting speed limits, torque output, or other operational parameters originally configured by MOD BIKES.


Drivetrain Modifications: Applying alterations to the drivetrain system, including gearing, chainring, bottom bracket, or derailleur configurations, that have not been explicitly approved or recommended by MOD BIKES.


Brake System Modifications: Changes to the brake calipers, rotors, brake lines, or any braking mechanism that may adversely affect braking performance, safety standards, or compliance with regulatory requirements.


Suspension System Adjustments: Modifications to suspension forks, shock absorbers, or damping mechanisms that could potentially compromise the e-bike’s handling characteristics, stability, or safety.


Lighting and Visibility Modifications: Installation of lighting systems, reflectors, or visibility aids that do not conform to approved standards or regulations, thereby potentially compromising visibility and road safety.


Cosmetic Alterations: Substantial modifications altering the e-bike’s aesthetic appearance, such as repainting, powder-coating, or structural changes affecting corrosion resistance or protective coatings.


Integration of Non-Approved Accessories: Use of accessories, mounts, or attachments not explicitly approved or recommended by MOD BIKES, potentially leading to functional interference or compromise of e-bike performance.


Warranty Voidance:


The warranty coverage provided by MOD BIKES shall be considered void upon identification of any of the aforementioned modifications or customizations. Voidance of warranty means that MOD BIKES shall bear no liability for repair or replacement costs associated with affected components or the e-bike as a whole, where such modifications directly contribute to or exacerbate the defect or damage necessitating warranty service.


This enumeration serves as a guideline, with MOD BIKES retaining the prerogative to assess and determine other modifications impacting warranty coverage based on individual circumstances and evaluation criteria. Owners are encouraged to exercise responsible customization within these guidelines to ensure continued enjoyment and safety of their e-bike.

Warranty Does Not Cover

Additional parts not mentioned above are not covered under warranty.  Damage caused by failure to follow MOD BIKES Instructions, Warnings, Terms and Conditions is not covered under warranty.


Normal Wear and Tear

Damage that naturally and inevitably occurs as a result of day-to-day riding and such damage or resulting maintenance needs are not covered under MOD BIKES warranty. The following is a non-exhaustive list of other typical wear and tear items not covered by our warranty:

  • Brake Pads
  • Chains
  • Grips
  • Tires and inner tubes
  • Brake cables and housing
  • Spokes
  • Stripped threads/ bolts
  • Bell
  • Saddle
  • Paint, logo, graphics
  • Kickstand


Water Damage

MOD BIKES warranty does not cover water damage of any kind. MOD BIKES are designed to be splashproof, but not waterproof. They can withstand light rain, but cannot be submerged. If a component is opened up and there is water inside or otherwise evidence of damage caused by moisture intrusion, the warranty is voided and is the responsibility of the customer.

Corrosion or Rust

Most MOD BIKES components are made of aluminum or stainless steel. Following industry standards, some components are metal and are more prone to rust and corrosion if not maintained properly. Beach riding can cause exposure to salt water and/ or salty breeze which can damage metal components over time and is not covered under MOD BIKES Warranty.  Bikes should be properly stored and not left out, subject to the elements.  If a MOD BIKE shows clear corrosion or rust, then the warranty is voided.


Damage/failure caused by tampering or use of unauthorized parts or accessories and/ or modification of components

Unauthorized alterations, interventions, or substitutions made by the user or third parties, as well as deliberate modifications that go beyond the manufacturer's intended use, are not covered under the MOD BIKES warranty. This includes the use of unauthorized parts or accessories and making changes to the original components, such as altering wiring, circuits, connectors, or mechanical parts, in a way that deviates from the bike's original specifications and design. Only electrical systems provided with your MOD BIKE should be used for charging and maintenance.  Should other electrical components not provided with your bike be used, it will void any warranty as to the electrical systems.

Misuse/ Neglect

Failure to take appropriate actions to maintain your bike or engaging in activities that can damage the bike or its components may compromise its performance, safety, and durability are not covered by MOD BIKES warranty. Neglecting routine tune-ups can lead to failure or damage to the bike’s components. Leaving a bike idle for long periods, can lead to battery capacity loss, self-discharge, voltage imbalance, and damage to the battery management system Overcharging and other improper use of battery maintenance systems can result in similar damage. Exceeding the payload capacity of the bike can result in failure or damage and is not covered under warranty.  Damage caused by or during other improper and unintended use of your MOD BIKE, such as racing, jumps, tricks, and stunts is not covered by this Limited Warranty. 

**Do not attempt to perform jumps, stunts, or any other tricks that are outside the parameters of this means of transport and your abilities.

Accident/Collision

Damage caused by dropping your MOD BIKE or an accident or collision is not covered by this Limited Warranty.  Furthermore, damage caused by operator error is also not covered by this Limited Warranty.

Warranty Labor

The bicycle owner is responsible for covering all labor charges associated with warranty service, including the transfer of components and/or installation of new components. MOD BIKES is responsible for providing the replacement component and visual and/or written installation service for replacing the warrantied part. Labor charges outside of this are not covered by the MOD BIKES warranty.


Stolen/Lost Bike

In the event of a stolen or lost bicycle, MOD BIKES warranty does not cover the original purchase or apply in any way.

Rentals, Commercial Use

The MOD BIKES limited warranty does not cover any MOD BIKE used for rental or commercial purposes.  Such use puts more wear and tear on the bikes than single-users.

Recommend Bike Insurance

Because bicycle ownership is full of unpredicted events, we encourage every MOD BIKES customer to invest in bicycle insurance. Beyond protecting the financial investment you've made in your bike, insurance provides a crucial safety net in case of accidents, theft, or damage to your MOD BIKES. In the unfortunate event of a collision, bike insurance can cover medical expenses and liability costs, ensuring that you're safeguarded against unexpected financial burdens. Additionally, comprehensive bike insurance often includes coverage for accessories, personal belongings, and even roadside assistance, enhancing your overall peace of mind while cycling. By securing the right bike insurance policy, you not only protect your interests but also contribute to a safer and more responsible cycling community.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND MOD BIKES’ ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. MOD BIKES’ LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE MOD BIKE, NOR SHALL MOD BIKES UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.


SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.


TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MOD BIKES DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE FOR THE DURATION OF THIS EXPRESS LIMITED WARRANTY.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
